Template for product launch — have qualified counsel review before production use.
1. The Service
ฅ^•ﻌ•^ฅ is a multi-tenant blogging platform that helps you publish content stored primarily in your own GitHub repositories, with hosting and a management dashboard provided by us.
2. Accounts
- You must authenticate with GitHub and keep your credentials secure
- You are responsible for activity under your account
- You must provide accurate information and be legally able to enter this agreement
3. Your content & GitHub
- You retain ownership of content in your repositories
- You grant us a limited license to access, process, cache, and display content as needed to operate the Service
- You represent that you have rights to the repositories and content you connect
- You are responsible for complying with GitHub’s terms and applicable law
4. Acceptable use
You agree not to:
- Break the law or infringe others’ rights
- Distribute malware, spam, or abusive content
- Attempt unauthorized access to the Service or other tenants
- Resell or abuse free tiers in a way that harms platform stability
- Overload infrastructure or reverse engineer except as allowed by law
5. Plans, billing & trials
- Features may depend on your plan (see Pricing)
- Paid plans are billed in advance via our payment processor (Airwallex)
- Fees are generally non-refundable except where required by law or explicitly stated
- We may change prices with notice; changes apply to subsequent billing periods
- Failure to pay may result in suspension or downgrade to Free
6. Custom domains & DNS
If you attach a custom domain, you are responsible for DNS configuration at your registrar. Platform hostnames depend on our DNS automation and may change as we operate the Service.
7. Intellectual property
The Service software, branding, and documentation are owned by us or our licensors. Open-source components are governed by their respective licenses.
8. Third-party services
The Service depends on third parties (including Cloudflare, GitHub, and Airwallex). Their outages or policy changes may affect availability. We are not responsible for third-party services beyond our reasonable control.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR USD $50 IF YOU ARE ON A FREE PLAN).
11. Indemnity
You will defend and indemnify us against claims arising from your content, your repositories, your domains, or your misuse of the Service.
12. Suspension & termination
You may stop using the Service at any time. We may suspend or terminate access for Terms violations, risk to the platform, or non-payment. Upon termination, we may delete account data per our Privacy Policy. Your GitHub content remains in your repositories.
13. Changes to the Service or Terms
We may modify the Service and these Terms. Continued use after the “Last updated” date constitutes acceptance of changes, except where mandatory law requires otherwise.
14. Governing law
Unless mandatory local law applies, these Terms are governed by the laws of the jurisdiction of the Service operator (to be specified by the operator at launch), excluding conflict-of-law rules.
